The Treaty Law Division of Global Affairs Canada is part of the Department’s Legal Affairs Bureau. The Division is responsible for providing legal advice to the federal government on international treaty law and Canadian treaty practice, and reviews all legally binding and non-legally binding international instruments negotiated and entered into on behalf of the Government. The Division is also responsible for administering Canada’s treaty adoption process and the current Policy on Tabling of Treaties in Parliament, including the preparation of formal instruments relating to the signature and entry into force of international treaties by the Government of Canada. The Division maintains the original text or a certified copy of treaties signed by Canada and publishes on an annual basis in the Canada Treaty Series (CTS) the texts of agreements that have come into force for Canada. 1 The Amendments to Annex III automatically entered into force internationally for all parties, including Canada, on 16 September 2019. On 6 April 2022, an Order-in-Council was issued by the Governor-in-Council, granting domestic authority to accept the Amendments on behalf of Canada, for the purposes of good governance at international law, conformity with Canadian treaty practice and consistency of obligations in domestic law and at international law.

2 Annex VII automatically entered into force internationally for all parties that did not submit a notification of non-acceptance, including Canada, on 6 November 2020. On 6 April 2022, an Order-in-Council was issued by the Governor-in-Council, granting domestic authority to accept Annex VII on behalf of Canada, for the purposes of good governance at international law, conformity with Canadian treaty practice and consistency of obligations in domestic law and at international law.

3 Les Amendements à l’annexe III sont entrés en vigueur automatiquement à l’échelle internationale pour toutes les Parties, y compris le Canada,

le 16 septembre 2019. Le 6 avril 2022, un décret accordant l’autorisation d’accepter les Amendements au nom du Canada au niveau national a été pris par la gouverneure en conseil, dans l’optique d’assurer une bonne gouvernance en droit international, le respect de la pratique canadienne en matière de traités et la cohérence des obligations juridiques sur le plan national et international.

4 L’Annexe VII est entrée en vigueur automatiquement à l’échelle internationale pour toutes les Parties qui n’ont pas communiqué une notification de non-acceptation, y compris le Canada, le 6 novembre 2020. Le 6 avril 2022, un décret accordant l’autorisation d’accepter l’Annexe VII au nom du Canada au niveau national a été pris par la gouverneure en conseil, dans l’optique d’assurer une bonne gouvernance en droit international, le respect de la pratique canadienne en matière de traités et la cohérence des obligations juridiques sur le plan national et international.
